OPPORTUNITIES FOR CANADA - LMIA

Canada is always keen to boost its economy, and the employment of foreign workers to undertake certain roles is a wonderful means of achieving this.

The LMIA process requires the submission of specific documentation that contains strict guidelines.

LMIA MEANS

A Labour Market Impact Assessment (LMIA) is an official document that an employer in Canada may require before hiring a temporary worker. The LMIA is only valid for a specific role and must state the job title, location and hours of work.

Once a foreign worker has been selected for a role, they are able to apply for a work permit.

The completed LMIA will be sent to Employment and Social Development Canada (ESDC) who will assess the application based on merit. A successful outcome is known as a ‘positive LMIA’.

A positive LMIA is verification that no permanent resident can undertake the role, and sometimes referred to as a confirmation letter. It is a lengthy process requiring documentation and statistics relating to unsuccessful candidate applications, and hiring employers must demonstrate equality and fairness with regard to wage/salary and working conditions. Its overall purpose is to protect Canada’s domestic job workplace, as well as ensure that foreign temporary workers are treated equally to their Canadian counterparts.

The cost of an LMIA application fee is approximately $1000 per foreign worker.

REQUIREMENTS

There are strict guidelines relating to the eligibility of a foreign worker. The worker must undertake stringent language testing to demonstrate a certain level of either English or French which are the main languages of Canada. The worker is also unable to undertake additional roles with their LMIA, it is valid only for the role in question. If another role is sought or acquired at a later date, they must apply for another LMIA.

For an employer, they must prove that the role has been advertised across numerous platforms to ensure that permanent residents have been given a fair opportunity to apply. If they have failed to do so, their application is likely to be declined. Information relating to the role on offer, wage, location and duties must be detailed, as well as ensuring that unrepresented groups are able to apply. It is essential that the employment of a foreign worker will not affect the role of an existing Canadian worker in terms of shortened hours or termination.

WORK PERMITS FOR EUROPE

WHY CHOOSE EUROPE?

Europe is thriving with opportunity for skilled foreign workers. In the past few decades, it has seen an increasing flow of migrants from across the globe, with Asia becoming the key source for labour shortages. Europe offers greater earning potential and an opportunity to improve your existing skillset. A European passport is a wonderful thing to obtain.

There are certain processes required of a foreign worker seeking employment in Europe. If there is an offer of employment and these requirements are suitably met, a worker can relocate within just a few months from the time of their application.

WHAT IS A WORK PERMIT ?

There are 27 member countries within the EU, and each has its own work permit policy – there is no generic European permit.

When you begin your application, you will need to check the requirements of the country you have chosen to work in. As a rule of thumb, it is always advisable to thoroughly research your chosen country before relocating so that you know what to expect. Before an individual is able to undertake work within Europe, a work permit bust be obtained. This is an official statement that verifies the persons right to work within the country. Work permits are generally issued for a particular job and fall under the remit of short-term jobs or professional jobs.

You will need to demonstrate evidence of your work obligations and leave the country no later than the date shown on your visa. It is important to note that the terms ‘visa’ and ‘permit’ are used interchangeably. For the purpose of clarity, a visa is an essential piece of documentation that provides a user with permission to gain entry to a particular country. A work permit is a legal authorisation allowing a person to work in a foreign country.

POPULAR JOBS

Currently, the most sought-after professional jobs within Europe include construction workers, cleaners, electricians, plumbers, kitchen helpers, cooks, drivers and security guards. Due to the nature of these roles, there is a greater possibility of acquiring a permit for qualified workers, providing there are labour shortages relating to the role in question.

Those that seek unskilled roles are unlikely to be unsuccessful with their application.

LANGUAGE

Foreign workers must demonstrate that they have a specific level of language for the appropriate country. It is advisable to research your chosen country to learn more about the spoken language.

PROCESS

Though the permit processes will vary dependent upon the nature of the role, it will begin with an offer of work from a European employer. In order to qualify, the employer must prove that attempts have been made to recruit an EU-national without success.

Providing they have evidence supporting this, they can then apply for the permit on behalf of the individual. This process can be extremely straightforward or highly complicated – sadly, there is no one-size-fits-all due to the variables that need to be considered, including country of origin, skills and salary level.

Once the permit is approved, the individual will pay a processing fee before they are able to commence work. It is likely that a visa interview will be required in order to check credentials and get to know candidates a little better. Due to processing times, it is recommended that permits are applied for at least two months prior to travel.

When the permit has been granted, it is valid for 1-3-years. However, upon its expiry, there is an opportunity to apply for an extension. This is a further application process, but much less complicated than the previous.

PROCESSING TIMELINES

On average, a work permit has a waiting time of 6-7 months. For this reason, it is advisable to apply as soon as possible.

REQUIREMENTS

There are a number of things that you must prepare and complete for your application. These include:

► An average of a Canadian Language Benchmark (CLB) 5 is required.

► Experience in the required sector.

► A passport photo.

► A valid passport (that is valid for at least a further three months from           the time of application) and copies of previous visas.

► Flight details to Europe (though not always necessary).

► Proof of accommodation.

► Proof of qualifications.

► An employer contract from your future employer.

► A medical insurance policy covering expenses of up to EUR 30,000.

► Proof of civil status (marriage certificate, birth certificate of children, death certificate of spouse etc., ration card if applicable).

► A bank statement to demonstrate your minimum funds.

► Income Tax return form or Certificate of Income Tax deducted at the source of salary.

The cost of your permit will vary based on the country of origin.
